AI Liability

As the use of AI becomes more common on a daily basis, we need to face the question of who must foot the bill if the use of AI causes harm to someone. AI has certain properties that challenge the applicability of traditional liability rules. This training will shed light on the core problems linked to liability for damage caused by AI in different contexts.

BENEFITS AND OBJECTIVES

Competence goals:

After the completion of this course, you will 

  • Be familiar with key questions surrounding the topic of liability for damage caused by AI.
  • Have substantial knowledge about the ongoing policy discussions at the EU level and at the international level, where applicable.
  • Have knowledge about liability for defective products. 
  • Have understanding of what kind of copyrighted materials are being produced in an organisation in everyday business, to whom the rights belong and how they affect to using AI systems.
  • Have tools to assess the responsibilities and risks feeding copyrighted content in AI systems, and using AI produced contents in the organisation and outside of it.
  • Be able to apply the knowledge in relevant work contexts and in your organisation.
  • Upon successful completion of the training, you will receive 1 cr from the Faculty of Law at the University of Helsinki.
     

The training is part of the Responsible AI-Powered Organization training programme. After this module you have relevant basic skills to advance towards modules for more specific sustainability and ESG regulation.

TARGET AUDIENCE 

The training is suitable for anyone interested in the topic. Primarily, it is designed for professionals from various fields who want to develop their expertise in this area. The language of instruction will be mainly English.

The selection of participants for the training will be confirmed by the Service Center for Continuous Learning and Employment. After the selection, we will send the applicants an email with information about the selection and instructions for the next steps. 

The number of participants is limited.

CONTENT AND SCHEDULE

AI Liability training consists of dissemination of knowledge on core problems in relation to liability for damage caused by AI. This includes critical AI properties such as autonomy and opacity, i.e. the ability of AI systems to perform tasks with little to no human intervention and the problem of the system being a black box, meaning it is hard to understand its decision-making process. Further, we will address the question of who can be liable. The user? The programmer? The system itself? 

In addition, we will cover relevant policy discussions.

The recently revised regime on liability for defective products in the EU (Product Liability Directive) is also relevant in this regard and will be covered.

The course focuses also on copyright-related risks and liabilities in using AI in an organisation. The relevant questions are what kind of content can be legally introduced to an AI system, and who bears the responsibility of potential IPR infringements in the input process. Secondly, who bears the responsibility in using an AI product in the organisation or outside of it? These questions are assessed under copyright liability rules and in the light of the EU AI Act, especially around Article 50 (transparency Obligations for Providers and Deployers of Certain AI Systems).
 
The sessions will take place online, on May 6, May 13, May 20 and May 27, at 14-16 Finnish time.

In the first two sessions, we will address general questions on liability for AI, the session on 20 May will address copyright-related aspects and the final session on 27 May will address product liability.

SKILL LEVEL AND THE ASSESSMENT

The skill level of the module is 3/5 (competent problem solver / performer). 

Competence is assessed on a pass/fail scale based on the assignments.

TEACHERS

The teachers in this module are doctoral researcher Didem Polad (University of Helsinki), doctoral researcher Tahoora Heydari (University of Helsinki), grant-funded researcher Tuomas Mattila and postdoctoral researcher Béatrice Schütte (University of Lapland).

The training has been funded by the Service Centre for Continuous Learning and Employment. The Service Centre promotes the competence development of working-age people and the availability of skilled labour. The operations of the Service Centre are overseen by the Ministry of Education and Culture and the Ministry of Economic Affairs and Employment.

No more than 20% of the participants from the same organization will be selected for the training.
